General Terms and Conditions (GTC)
These General Terms and Conditions apply to the use of the Software-as-a-Service platform HouseControl.at, operated by Ing. Stephan Rudolf Landsteiner, Online-Agentur Landsteiner (hereinafter “Provider”). The contractual partner is the natural or legal person who concludes a subscription or uses a license code issued by the Provider.

1. Subject of the contract
The provider offers web-based software via the internet for the digital management of residential complexes, units, residents, notifications, surveys, votes, documents, calendars, operating costs, service providers, and orders. The specific range of functions depends on the chosen plan, the activated role, and the technical capabilities of the platform.
2. Registration and access
Users must provide accurate and current information when registering and using the service. Access data must be treated confidentially. The provider may require additional security measures such as email verification, two-factor authentication, or re-MFA confirmation for sensitive operations.
The user is responsible for granting access only to authorized persons and for correctly maintaining roles, building, unit, and resident assignments.
3. Test mode
The test mode can be activated after explicit confirmation. It is exclusively for testing the platform, is time-limited, and may be functionally restricted. Test buildings and content created in test mode will be automatically cleared after expiration. The test mode does not establish any claim to permanent storage or productive use of test data.
4. Subscription, units and termination
Subscriptions are processed according to the information on the Pricing Page plans shown have been concluded. The number of manageable units depends on the subscribed plan or the purchased quantity. Changes, cancellations, or quantity adjustments are generally made via the Stripe customer portal or through administrative channels approved by the provider.
A subscription automatically renews for the selected billing period, unless canceled before the end of the current billing period. After cancellation, access generally remains until the end of the period already paid for.

5. Prices and payment
The currently valid prices are listed on the pricing page. Unless otherwise stated, prices include statutory VAT. Payments are processed via Stripe. The provider does not store complete credit card data.
In case of payment default, chargeback, or abusive use, the provider may temporarily restrict access or terminate the contractual relationship for good cause.
6. Usage rights and obligations
For the duration of the contract, the provider grants a simple, non-transferable right to use the platform. The user may not misuse the platform, circumvent security measures, launch automated attacks, decompile, copy, or use it for unlawful content or unlawful data processing.
Content, documents, votes, signatures, and personal data may only be processed if there is a sufficient legal basis for doing so.
7. Availability, maintenance and changes
The provider strives for stable availability of the platform. Continuous, uninterrupted accessibility is not guaranteed, unless expressly agreed otherwise. Maintenance, updates, security measures, and technical changes may temporarily restrict functions.
8. Data protection and data processing agreement
The processing of personal data is in the Privacy Policy described. Insofar as the provider processes personal data on behalf of the customer, a data processing agreement must be concluded before productive use, if required by data protection law.
The client remains responsible for the legality of the resident, owner, service provider, building, and administrative data entered by them.
9. Recommendations and partner programs
The provider may offer referral or partner programs. Remuneration, commission, or credit only arises if expressly agreed upon and if the respective referral, after internal review, is permissible, verifiable, and not abusive. The provider may reject referrals, especially in cases of self-promotion, sham registrations, cancellations, chargebacks, advertising contrary to the contract, or other misuse, or reverse claims already noted.
Separate partner conditions may apply to marketing partners. Partners are solely responsible for transparently disclosing legally required advertising and affiliate notices.
10. Liability
The provider is liable according to statutory provisions for intent and gross negligence. For slight negligence, the provider is liable only for the breach of essential contractual obligations and limited to the typical, foreseeable damage, to the extent permitted by law. Liability for incorrect data entries, unauthorized role assignments, or unlawful user content is excluded, to the extent permitted by law.
11. Suspension and termination for good cause
The provider may block access or terminate contracts for good cause, particularly in cases of misuse, attacks on the platform, payment default, serious breaches of these GTC, or unlawful use.
12. Amendments to the GTC
The provider may amend these GTC if technical, legal, or economic reasons require it. Significant changes will be communicated in due time. If the user objects to a change, the contractual relationship may be terminated at the next possible date.
13. Applicable law and jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is, as far as legally permissible, the competent court at the provider's registered office.
